Pursuant to the Local Government Scheme of Service and relevant extant laws, the Legal Department of Obio/Akpor Local Government Council serves as the principal advisory and compliance unit, ensuring that all Council activities are undertaken in accordance with applicable legal frameworks and best governance practices. The Department is committed to safeguarding the legal interests of the Council while promoting transparency, accountability, and due process.
Core Functions and Responsibilities:
- Legal Advisory Services:
Provide timely and sound legal advice to the Executive Chairman, Council officials and management , and all departments on matters relating to governance, policy implementation, and statutory obligations.
- Drafting and Review of Legal Documents:
Prepare, vet, and review contracts, agreements, memoranda, bye-laws, policies, and other legal instruments to safeguard the Council’s interests. - Litigation and Dispute Resolution:
Represent and defend the Council in all legal proceedings. Manage disputes involving the Council and explore alternative dispute resolution mechanisms where appropriate. - Regulatory Compliance:
Ensure that the Council’s operations comply with all relevant local, state, and federal laws, regulations, and guidelines. - Legislative Support:
Provide legal input in the formulation, interpretation, and enforcement of Council bye-laws and policies in collaboration with the Legislative Arm of the Council. - Contract Management and Due Diligence:
Oversee the legal aspects of procurement processes, partnerships, and projects by conducting due diligence and ensuring contractual compliance. - Public Interest Protection:
Safeguard the Council against legal risks while ensuring that decisions and actions are in the best interest of the public. - Legal Awareness and Capacity Building:
Promote legal literacy within the Council by guiding departments on compliance requirements and emerging legal issues. - Records and Documentation:
Maintain proper records of all legal documents, court processes, and advisory opinions for reference and institutional memory
